By accessing or using Frencheers ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

3. Subscription and Payment

3.1 Subscription Plans

We offer the following subscription plans:

  • Free Tier: Limited access, no payment required
  • Monthly Plan: $5/month
  • Annual Plan: $50/year
  • Lifetime Plan: $300 one-time payment

3.2 Payment Terms

  • All payments are processed through Stripe
  • Prices are in USD and include applicable taxes
  • Subscriptions auto-renew unless cancelled
  • No refunds for partial subscription periods

3.3 Lifetime Plan

The Lifetime Plan provides access for the lifetime of the Service. If the Service is discontinued, no refunds will be provided for Lifetime Plan purchases.

4. User Account

4.1 Account Creation

  • You must be at least 13 years old to use the Service
  • You must provide accurate and complete information
  • You are responsible for maintaining account security

4.2 Account Termination

We reserve the right to terminate or suspend accounts for:

  • Violation of these Terms
  • Suspicious or fraudulent activity
  • Extended period of inactivity
  • At user's request

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to access restricted areas of the Service
  • Share your account credentials
  • Reverse engineer or attempt to extract source code

  • Our learning materials, algorithms, and methodologies are proprietary
  • The Service includes content from various open-source and licensed resources

6.2 User Rights

  • You may use the Service for personal, non-commercial learning
  • You may not redistribute, sell, or license any content from the Service

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Error-free or uninterrupted operation
  • Accuracy of content or learning materials
  • Achievement of any specific learning outcomes

8. Limitation of Liability

8.1 General Limitation

To the maximum extent permitted by law, Frencheers and its operators, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Cost of procurement of substitute services
  • Any damages resulting from:
    • Service interruptions or performance issues
    • Unauthorized access to or alteration of data
    • Statements or conduct of any third party on the Service
    • Computer viruses or other malicious code
    • Natural disasters or force majeure events

8.2 Cap on Liability

In no event shall our total liability for all damages exceed the amount you paid us in the 12 months preceding the incident, or €100 if you are using the free tier.

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

9.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts of Paris, France, and you hereby consent to the personal jurisdiction of such courts.

9.3 Individual Claims

You agree that any claims against Frencheers must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Posting the updated Terms on our website
  • Displaying a prominent notice in the Service

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
